Case Overview

Jeff was riding his Harley-Davidson motorcycle on a charity toy run when he came upon a construction zone in Northern Wyoming. As he approached an intersection, he noticed traffic signs and followed them. However, when his bike hit an abrupt, unmarked transition from dirt to asphalt, he crashed.

Stinson Law Group delved into the “uniform traffic safety device” manual and discovered that the construction company had placed signs inappropriately and, to make matters worse, used the wrong signage. This oversight meant that Jeff didn’t receive proper notice or warning about the road conditions. Unfortunately, the road company refused to take responsibility and cover Jeff’s medical expenses.

Jeff B.

Holding a Construction Company Accountable

The construction company’s negligence caused a traumatizing crash for Jeff, and we were able to hold them accountable for the needless harm they caused. The safety rules put in place to protect us all were essentially ignored, but we were able to remind them of the responsibility they hold to the public.

Addressing our Client’s Needs

While Jeff’s crash was not lethal, it resulted in medical expenses, prescribed surgeries, and more financial hardships he will be dealing with for months, if not years, to come. Our goal was to get Jeff the financial support he needed to cover these costs. We were able to secure the funds he needed to move forward.

Stinson Law’s Legal Strategy

In this case, we adopted a unique approach. Instead of incurring substantial expenses on experts, we leveraged the court tools to scrutinize the contract signed between the road construction company and the state. This contract mandated the construction company to take “all necessary steps” to ensure public safety. The court ruled in our favor that the construction company had a duty of safety.

Challenges We Faced

The opposing lawyer never truly grasped the nuances of the case and consistently perceived it as a mere instance of poor motorcycle riding despite Jeff’s decades of accident-free motorcycling. Additionally, a significant challenge we faced was that this crash was classified as a single-vehicle incident.

Legal Action

We made sure to dig deep into the documents early in the case, subsequently filing early motions with the court regarding wrongdoing and loss of evidence. These strategic motions paved the path to our ultimate victory.

Results & Outcome

We engaged in mediation and presented our evidence against the road contractor to the insurance adjustors for the construction company. With all the evidence on the table, it was compelling enough to convince the adjusters we were in the right. They ultimately agreed to a substantial settlement to resolve the case. As a result, Jeff secured funds for future medical expenses.

Client Testimonial

Initially, I did not reach out to Stinson Law Group. I hired another attorney in Cody, WY. He strung me along for almost two years without doing much and then panicked, reaching out to another set of lawyers. They both dropped the ball, not giving a shit about me. They both left me hanging just before the statutes of limitations ran out. My first lawyer recommended the Stinson Group; that is how it all came to be.

I have known Laurence and Scott for many years. They were both customers of mine at my retail store located in Cody, WY. I knew that they were both Lawyers but really did not know that their specialty was personal injury.

I had little to no experience hiring an attorney in the past, and I will say that this was an eye-opening experience and created a better understanding of how this particular machine operates. The team, every one of them, was absolutely professional and concerned about my case. I am not sure that the Stinson brothers could have selected a better group of people. Suzi and Robin were the two that I had the most contact with, other than Laurence, of course, and again, they functioned like a hand-built precision clock. All gears and movements were perfectly aligned. They all were in contact with me, and I never felt as if they forgot me.

Stinson Law did everything they could for me. They all worked hard and earned their money on this case.

Something that stood out to me was the fact that I was a noobie and had little to no experience engaging in the legal system, I absorbed an immense amount of detailed information about how personal injury cases are presented and defended and the multitude of outcomes that are possible.

If you find yourself in a similar position, first and foremost, do not be afraid or intimidated to consult with an attorney. If you are hurt as the result of someone else’s negligence, you should absolutely speak with a legal representative. I never would have reached out to an attorney without one of my comrades suggesting that I do so. It’s not part of my behavior to blame someone else. I would have just lived with the physical ailment the rest of my life without pursuing anything legal.

I am satisfied with the outcome but will always wonder if financially I would have been better off not settling before the trial and actually going through with the actual trial. I am convinced that Scott and Laurence would have been able to recover more money at trial, but the entire experience is very scary and intimidating, and I wanted it to be over.

Working with Stinson Law was an A+ experience. Have you ever experienced anything in life that was just perfect? Something that scared you to death but went extremely well? Like jumping out of an airplane and your parachute opens perfectly, and you float to the ground and land on your feet? In a nutshell, that’s the way I feel about working with them. The entire team at Stinson Law Group will do their best to make sure that you are treated with dignity and respect, no matter how difficult your case may be.
